1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Checkride digital flight training platform, including the Checkride website, web application, mobile applications, APIs, and any related services (collectively, the "Service") operated by Checkride LLC ("Checkride," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
You represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and accepted these Terms on your behalf, consents to your use of the Service, and remains responsible for your account and any activity through it. If you are using the Service on behalf of an organization (such as a flight school), you represent that you are authorized to bind that organization to these Terms.
You consent to receive communications from Checkride LLC electronically (including email, in-app notices, and postings on the Service) regarding these Terms, billing, security, and operational matters.
1.1 Definitions
- "Checkride LLC" means Checkride LLC, the company that operates the Service.
- "Service" means the Checkride websites, applications, APIs, and related services offered by Checkride LLC from time to time.
- "User" or "you" means the individual or entity accessing or using the Service.
- "User Content" means information, files, logbook data, signatures, and other materials you submit to the Service.
1.2 Intended Users and Geographic Scope
The Service is designed for pilots, students, instructors, and flight schools based in the United States and is built around U.S. aviation training and the Federal Aviation Regulations. While we don't restrict access by location, we don't currently tailor the Service to users outside the United States, and some features, payment options, or content may behave differently or be unavailable in your region. If you choose to use the Service from outside the United States, you're doing so on your own initiative and are responsible for any local-law requirements that apply to you.
2. Description of Service
Checkride LLC provides a digital platform intended to support flight training and aviation education. Depending on your account type, subscription level, and the features then made available to you, the Service may include:
- Digital logbook management and flight time tracking
- AI-assisted features, including the "Sky" assistant and AI-generated training recommendations
- Training progress, milestone, and requirement tracking
- Communication, scheduling, and approval tools related to training
- Electronic signatures, endorsements, and document generation for training records
- Push and in-app notifications, including via our mobile applications
- Reporting, analytics, and export functionality
Important: Not all features described above are necessarily available to all users at all times. Availability may depend on your subscription, eligibility, region, or product updates. The Service is provided as it then exists, not as described aspirationally in these Terms.
3. User Accounts and Registration
3.1 Account Creation
To use most features of the Service, you must register for an account by providing accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information and for all activity that occurs under your account.
3.2 Email Verification
After registration, we will send a confirmation email to the address you provided. You must confirm your email address by following the link in that email. We provide a limited grace period during which you may use the Service without confirming, after which access may be restricted until confirmation is completed. If you sign up using an identity provider such as Apple, your email may be considered verified by that provider.
3.3 Account Security
- Use strong, unique passwords and enable additional authentication factors when available
- Notify us promptly of any unauthorized use of your account
- Log out of your account when using shared or public devices
- You remain responsible for activity under your account until we are notified of, and are reasonably able to act on, a credential compromise
3.4 Account Types and Permissions
Different accounts may have different capabilities depending on how the Service is used and how Checkride LLC provisions access. Checkride LLC may offer complimentary or trial access from time to time; such access can be limited or withdrawn without a fee refund unless applicable payment rules say otherwise.
3.5 Account Termination
You may close your account at any time. We may suspend or terminate any account, with or without notice, for violation of these Terms, suspected fraud, abuse, security risk, non-payment, or for any reason permitted by law. Upon termination, your right to use the Service immediately ends; provisions that by their nature should survive termination (including ownership, indemnification, disclaimers, limitation of liability, and dispute resolution) will survive.
4. Data Accuracy and User Responsibilities
Important: You are solely responsible for the accuracy, completeness, and validity of all information you enter into the Service, including flight time, training records, endorsements, certificate numbers, and aircraft data.
4.1 Data Entry Responsibilities
- Ensure that all logbook entries are accurate and reflect actual flights
- Verify training-authorization details and obtain required approvals before submission
- Maintain backup records of all training activities
- Cross-reference digital records against physical or official documentation
- Report any discrepancies, errors, or unauthorized changes promptly
4.2 Professional Use Standards
- Use the Service only for legitimate flight training, aviation education, and record-keeping purposes
- Comply with all applicable aviation regulations and requirements
- Respect professional boundaries between users of the Service
- Maintain the confidentiality of other users' information
5. FAA Compliance and Regulatory Disclaimer
Critical Notice: Checkride LLC is not affiliated with, endorsed by, sponsored by, or in any way officially connected to the Federal Aviation Administration (FAA), the Department of Transportation, or any other aviation regulatory authority. The Service is not an FAA system of record.
5.1 Regulatory Compliance
- The Service is intended to assist with record-keeping but does not guarantee regulatory compliance
- You must independently verify that your use of the Service satisfies all applicable FAA, state, and local requirements
- Consult with certified flight instructors, designated pilot examiners, or FAA representatives for official regulatory guidance
- Maintain official paper or system-of-record entries where required
5.2 Limitation of Regulatory Support
While we work to keep the Service aligned with current aviation regulations, we do not warrant that calculations, eligibility checks, currency tracking, or recommendations meet then-current FAA standards. Regulations change, and it remains your responsibility to remain informed and compliant.
6. AI Features and Third-Party Processing
6.1 AI Assistant and Recommendations
- Some guidance is generated automatically from your records on Checkride LLC systems; other personalization may involve outside vendors described in the Privacy Policy.
- Our AI features (including the "Sky" assistant and AI-generated training recommendations) provide general information and suggestions only
- AI output is not professional aviation, legal, medical, or financial advice and must not be relied upon as such
- Always verify AI-provided information with qualified aviation professionals and official sources before acting on it
- AI features may be inaccurate, incomplete, or out of date, and may produce unexpected results
6.2 Outside Processing for AI Features
When AI features rely on outside processors, Checkride LLC sends only what is reasonably needed for the feature. Details are in the Privacy Policy. Do not enter information into AI features that you would not want processed by a contracted vendor.
6.3 Automated Calculations and Analytics
- Progress tracking, currency calculations, and requirement completion are provided as estimates
- You are responsible for independently verifying all automated calculations
- Analytics and insights are derived from your data and should be validated before use in regulatory or training decisions
- System-generated suggestions are not professional advice
7. Digital Signatures, Electronic Records, and Audit Trails
7.1 Electronic Signatures
The Service supports electronic signatures for training-related approvals. By applying an electronic signature, you acknowledge that it is intended to have the same legal effect as a handwritten signature where permitted by applicable law (including the U.S. ESIGN Act and the Uniform Electronic Transactions Act). You are responsible for confirming that electronic signatures meet requirements applicable to you.
7.2 Audit Trails and Tamper Evidence
Training records and signatures may be logged with information reasonably needed to confirm who acted and when, including limited technical data where standard for online services. You consent to this logging where it supports integrity of the records you choose to maintain in the Service.
7.3 Electronic Record Keeping
- Electronic records maintained through the Service may have legal validity
- Export or back up your records regularly
- Maintain physical or alternate copies where required by regulation or institutional policy
- Confirm that electronic approvals and endorsements meet requirements that apply to you before relying on them
8. Privacy and Data Security
Our collection, use, and protection of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
We implement administrative, technical, and physical safeguards designed to protect your information. No system, however, is perfectly secure; we do not guarantee that the Service will be free of unauthorized access, errors, or loss.
9. Intellectual Property Rights
9.1 Checkride Property
All content, features, and functionality of the Service — including text, graphics, logos, software, designs, AI prompts and orchestration logic, and selection and arrangement of content — are owned by Checkride LLC or our licensors and are protected by U.S. and international intellectual property laws.
9.2 User Content
- You retain ownership of the flight training data and other content you submit ("User Content")
- You grant Checkride LLC a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, reproduce, and create derivative works of User Content solely as necessary to operate, secure, and improve the Service, comply with law, and provide it to you and people or organizations you authorize through the Service
- You may export and delete User Content as described in our Privacy Policy, subject to legal, regulatory, and audit-trail retention requirements
- You represent that you have all rights necessary to submit User Content and to grant the license above
9.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant Checkride LLC a perpetual, irrevocable, royalty-free, worldwide license to use them without restriction.
9.4 Prohibited Uses of Our IP
- Reverse engineering, decompiling, or attempting to extract source code
- Creating derivative works or competing services based on the Service
- Using automated tools to scrape or download content without permission
- Redistributing or reselling access to the Service
- Using outputs from the Service to train competing AI or aviation-software models
9.5 Copyright Complaints
If you believe content available on or through the Service infringes a copyright you own or control, send a written notice to legal@trycheckride.com that includes: (a) a physical or electronic signature of the copyright owner or someone authorized to act on the owner's behalf; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to let us locate it; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner. We may remove or disable access to material we believe in good faith to be infringing and may terminate the accounts of repeat infringers.
10. Payment, Subscriptions, and Plan Limits
Auto-renewal notice. Paid plans renew automatically at the end of each billing period at the then-applicable price for your plan and billing interval, and your saved payment method will be charged for the renewal, until you cancel. You can cancel anytime in Account > Billing; cancellation takes effect at the end of your current billing period.
10.1 Subscription Services
- Paid subscriptions are billed in advance on a recurring basis at the then-applicable rate for your plan and billing interval
- You authorize Checkride LLC and its payment processor to charge your payment method for recurring fees, taxes, and any other charges you incur
- Subscriptions automatically renew at the end of each billing period unless cancelled before renewal
- We will provide reasonable prior notice of material price changes; your continued use after the effective date constitutes acceptance
10.2 Cancellations and Refunds
- You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the then-current billing period
- Except where required by applicable law, fees are non-refundable, and we do not provide refunds or credits for partial billing periods, downgraded plans, or unused features
- Refund requests outside of legally required cases may be considered at our discretion
10.3 Plan Limits and Fair Use
Certain features may have fair-use or volume limits. Checkride LLC may enforce limits to protect reliability for all users and may adjust them with reasonable notice. Misuse or abuse may result in rate limits, suspension, or termination.
10.4 Complimentary or Trial Access
Checkride LLC may grant access without charging standard fees (for example trials or internal evaluation). That access is discretionary, may end at any time, and does not guarantee ongoing service or a refund.
10.5 Taxes
Fees are exclusive of taxes unless otherwise stated. You are responsible for any applicable sales, use, value-added, or similar taxes, except those based on our net income.
10.6 Payment Card Data
Payment card transactions are handled by a designated payment processor. Checkride LLC does not intend to store complete payment card numbers on its own systems; card handling is subject to the processor's privacy policy and practices.
11. Limitation of Liability and Disclaimers
IMPORTANT LEGAL NOTICE: Please read this section carefully. It limits our liability and your legal remedies. Some jurisdictions do not allow certain limitations, in which case the limitations apply only to the maximum extent permitted by law.
11.1 Service Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CHECKRIDE LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.3 Liability Cap
OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11.4 Aviation-Specific Disclaimers
Aviation activities are inherently risky. Nothing in the Service is a substitute for proper training, regulatory compliance, mechanical airworthiness, weather judgment, or pilot-in-command authority. We are not responsible for any decision made or action taken in reliance on the Service.
11.5 Communications Between Users
The Service includes features that let users communicate with one another — for example, instructor remarks on logbook entries, scheduling messages, and direct conversations between students and instructors. These communications are between the participating users. Checkride LLC does not review, monitor, endorse, or verify them and is not responsible for the substance of any advice, instructions, or statements one user makes to another. Use your judgment, and verify training-related guidance with qualified aviation professionals.
12. Indemnification
You agree to indemnify, defend, and hold harmless Checkride LLC, its officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your infringement of any rights of another party.
13. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulation
- Submit false, inaccurate, or misleading information, including falsified flight time
- Interfere with, disrupt, or overload the Service or other users' access
- Attempt to gain unauthorized access to any part of the Service or another user's account
- Use bots, scrapers, or automated tools to access the Service without prior written permission
- Upload malicious code, viruses, or other harmful content
- Harass, abuse, threaten, or harm other users or Checkride LLC personnel
- Share account credentials or allow unauthorized access to your account
- Use the Service to develop, train, or evaluate competing AI models or aviation training products
- Bypass any usage limit, feature gate, or access control
14. Service Modifications and Availability
14.1 Service Changes
We may add, modify, or discontinue features at any time. We will use reasonable efforts to communicate material changes through email or in-app notices.
14.2 Service Availability
We do not guarantee uninterrupted service. The Service may be unavailable from time to time due to scheduled maintenance, updates, third-party outages, or other technical issues.
15. Mobile Applications and App Store Terms
If you access the Service through a mobile application:
- Your use is also subject to the applicable app store terms (Apple App Store or Google Play)
- The mobile application may use device features such as biometric authentication (Face ID, Touch ID, or platform equivalents); biometric data is processed locally on your device and is not transmitted to or stored by us
- The mobile application may register your device with your platform's notification services so alerts can be delivered
15.1 Apple App Store
If you obtained the iOS application from the Apple App Store, you also acknowledge that:
- These Terms are an agreement between you and Checkride LLC only, not with Apple, Inc., and Apple is not responsible for the iOS application or its content.
- Your license to the iOS application is non-transferable and limited to use on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide any maintenance or support for the iOS application.
- If the iOS application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for it; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the iOS application.
- Checkride LLC, not Apple, is responsible for addressing any claims you or a third party may have relating to the iOS application or your use of it (including product liability, consumer-protection, and intellectual-property claims).
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the iOS application, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
16. Third-Party Services
The Service relies on vendors for payments, messaging, infrastructure, analytics, optional AI features, and similar functions. Those vendors apply their own terms. Checkride LLC is not responsible for their independent acts or omissions.
17. Governing Law and Dispute Resolution
This section describes where lawsuits may be filed and certain jury or class procedures that apply as permitted by law. Protections for consumers, workers, or residents of particular states may limit these provisions.
17.1 Governing Law
These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-laws principles that would apply another jurisdiction's laws. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17.2 Informal Resolution
Before filing any claim, you agree to first contact Checkride LLC at legal@trycheckride.com and attempt in good faith to resolve the dispute for at least thirty (30) days.
17.3 Forum Selection; Individual Claims
Subject to applicable law and the carve-outs below, you and Checkride LLC agree that any judicial proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of New York, and each party submits to the personal jurisdiction and venue of those courts.
To the fullest extent permitted by law, each party waives any right to participate as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. Claims must be brought on an individual basis only.
To the fullest extent permitted by law, each party waives any right to a jury trial for disputes resolved in court.
Either party may seek temporary or preliminary injunctive relief (including for intellectual property protection) in any court of competent jurisdiction without waiving this forum selection clause for subsequent proceedings on the merits. Either party may bring an individual action in small claims court if the dispute qualifies and remains in that court.
18. Changes to Terms
We may modify these Terms from time to time. If Checkride LLC makes material changes, Checkride LLC will notify you by email or in-app notice when practicable and update the "Last updated" date above. Material changes will become effective no earlier than the date stated in the notice (or immediately if required by law). Your continued use of the Service after the effective date constitutes acceptance of the updated Terms where permitted by law. If you do not agree, you must stop using the Service.
19. Miscellaneous
- Entire Agreement. These Terms, together with the Privacy Policy and any plan-level terms, are the entire agreement between you and Checkride LLC concerning the Service.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
- No Waiver. Our failure to enforce any right is not a waiver of that right.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force Majeure. Neither party is liable for delay or failure caused by events beyond reasonable control.
- Headings. Headings are for reference only and do not affect interpretation.
