5.1 Regulatory Compliance

• The Service is intended to assist with record-keeping but does not guarantee regulatory compliance
• You must verify that your use of the Service meets all applicable FAA requirements
• Consult with certified flight instructors and FAA representatives for official guidance
• Maintain official paper records as required by regulations

5.2 Limitation of Regulatory Support

While we strive to keep our platform current with aviation regulations, we cannot guarantee that all calculations, requirements, or recommendations will meet current FAA standards. Regulatory requirements may change, and it is your responsibility to stay informed.

6.1 AI Assistant "Sky"

• Our AI assistant provides general aviation information and guidance
• AI responses should not be considered professional aviation advice
• Always verify AI-provided information with certified instructors or official sources
• AI conversations may be recorded and analyzed to improve service quality

6.2 Automated Calculations and Analytics

• Automated progress tracking and requirement calculations are provided as estimates
• You are responsible for verifying all automated calculations
• Analytics and insights are based on data patterns and should be validated independently
• System-generated recommendations do not constitute professional advice

7.1 Digital Signature Validity

Our digital signature feature is designed to meet industry standards for electronic signatures. However, you are responsible for ensuring that digital signatures are acceptable for your specific regulatory and institutional requirements.

7.2 Electronic Record Keeping

• Electronic records maintained through our Service may have legal validity
• Backup and export your records regularly for safekeeping
• Maintain physical copies where required by regulation or institutional policy
• Ensure instructor approvals meet your local requirements

9.1 Checkride LLC Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, AI algorithms, and design elements, are the exclusive property of Checkride LLC and are protected by applicable copyright, trademark, and intellectual property laws.

9.2 User Content

• You retain ownership of your flight training data and personal information
• You grant us a limited license to use your data to provide and improve our Service
• You may export and delete your data at any time, subject to legal retention requirements
• You are responsible for ensuring you have rights to any third-party content you upload

9.3 Prohibited Uses

• Reverse engineering, decompiling, or attempting to extract source code
• Creating derivative works or competing services based on our platform
• Using automated tools to scrape or download content without permission
• Redistributing or reselling access to the Service

10.1 Subscription Services

• Subscription fees are billed in advance on a recurring basis
• You authorize us to charge your payment method for recurring subscription fees
• Subscription renewals are automatic unless cancelled before the renewal date
• Price changes will be communicated with at least 30 days notice

10.2 Refunds and Cancellations

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of your current billing period
• Refunds may be available within 30 days for annual subscriptions
• No refunds for partial months or unused subscription time

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECKRIDE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.3 Maximum Liability

Our total liability to you for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Submit false, inaccurate, or misleading information
• Interfere with or disrupt the Service or other users' access
• Attempt to gain unauthorized access to any part of the Service

• Share account credentials or allow unauthorized access to your account
• Use the Service to compete with or replicate our offerings

We reserve the right to modify, update, or discontinue any aspect of the Service at any time with reasonable notice. We may add new features, change existing functionality, or remove features as needed to improve the Service.

14.2 Service Availability

While we strive for high availability, we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or technical issues. We will provide reasonable notice of planned maintenance when possible.
